These Terms & Conditions (“Terms”) govern your use of our website (webtezza.com) and any services, software, or products you purchase or engage from us, including web and mobile application development, AI solutions, business management systems (CRM/ERP/POS), cloud and DevOps services, design and branding, and digital marketing. 1. About Us

Webtezza is a software and digital solutions company based at 159/1, Kandy Road, Paragahadeniya, Kurunegala, Sri Lanka, serving clients in Sri Lanka and internationally, including the Gulf, Europe, and Asia.

2. Use of the Website

• You agree to provide accurate and current information when contacting us, requesting a quotation, or making a payment.
• You are responsible for maintaining the confidentiality of any account credentials or access details provided to you (for example, access to a POS system, CRM, or staging environment).
• You may not use our website for any unlawful purpose, or in any way that could damage, disable, or impair our systems or interfere with other users.

3. Services and Engagements

• Specific deliverables, timelines, and pricing for any project (software development, AI solution, CRM/ERP/POS system, design, or marketing service) will be set out separately in a proposal, quotation, or agreement between Webtezza and the client.
• We make reasonable efforts to deliver projects within agreed timelines; however, timelines are estimates and may be affected by factors including client feedback delays, scope changes, or third-party dependencies.
• Any change to the agreed scope of a project may result in revised timelines and additional fees, to be discussed and agreed with you in advance.

4. Pricing and Payments

• Prices for our services and products are communicated through quotations, proposals, or invoices and are subject to change for future engagements.
• Payments made through our website are processed via our payment gateway partner. By making a payment, you authorize us to charge the agreed amount, including any applicable taxes.
• We do not store your full payment card details; these are handled securely by our payment gateway provider.
• Depending on the engagement, payments may be structured as deposits, milestone payments, one-time fees, or recurring subscription charges.

5. Cancellations and Refunds

Cancellation and refund terms are governed by our [Refund Policy]. In summary: if work has not yet begun on your project, you may request a full refund; once work has started, refunds are limited to the unused portion of the payment, assessed on a case-by-case basis. Costs already incurred on your behalf (such as third-party licenses, domains, or hosting) are non-refundable.

6. Intellectual Property

• Webtezza retains ownership of any pre-existing tools, frameworks, libraries, or proprietary systems (including our POS product) used in delivering your project, and grants you a license to use them as part of your delivered solution.
• All content on the Webtezza website including text, graphics, logos, and branding ,remains the property of Webtezza and may not be reproduced or used without our written consent.
• Third-party software, plugins, or licensed components used in your project remain subject to their own respective licenses.

7. Confidentiality

We treat business and project information shared with us as confidential and will not disclose it to third parties except where necessary to deliver the engaged services (e.g., to subcontractors bound by confidentiality obligations) or where required by law.

8. Client Responsibilities

• You agree to provide timely feedback, access, content, and information reasonably required for us to deliver your project.
• Delays caused by incomplete or delayed information from your side may affect project timelines and are not the responsibility of Webtezza.

9. Limitation of Liability

• Webtezza will perform services with reasonable skill and care, but we do not guarantee that software or systems will be completely free of errors or interruptions.
• To the extent permitted by law, Webtezza, its directors, and employees shall not be liable for indirect, incidental, or consequential damages (such as loss of revenue or data) arising from the use of our website, products, or services.
• Our total liability for any claim relating to a project shall not exceed the total amount paid by the client for that specific engagement.

10. Third-Party Services

Our services may involve integration with third-party platforms, APIs, hosting providers, or payment gateways (such as PayHere). We are not responsible for outages, policy changes, or issues arising from these third-party services, though we will assist in resolving such issues where reasonably possible.

11. Termination

Either party may terminate an ongoing engagement by mutual written agreement or as specified in the relevant project contract. Upon termination, payment is due for all work completed up to the termination date, and refund eligibility for unused payments will follow our Refund Policy.

12. Governing Law

These Terms are governed by the laws of Sri Lanka. Any disputes arising from these Terms or our services will first be addressed through good-faith discussion between the parties.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms. The “last updated” date above reflects the most recent revision.
